What is POPIA?
The Protection of Personal Information Act (Act No. 4 of 2013), commonly known as POPIA, is South Africa's data protection law. It regulates how organizations collect, store, process, and share personal information, ensuring the privacy rights of individuals are protected.
Our Role and Responsibilities
Africa Wide Consultancy acts as a Responsible Party under POPIA when processing personal information. We take our legal obligations seriously and have implemented comprehensive measures to ensure compliance.

Data Protection Principles We Follow
We adhere to the eight POPIA principles for lawful processing of personal information:
1. Accountability
We accept responsibility for all personal information under our control and have appointed an Information Officer to ensure compliance with POPIA.
2. Processing Limitation
We only collect personal information lawfully and with the knowledge and consent of the data subject, where required. We do not collect more information than necessary for the specific purpose.
3. Purpose Specification
We collect personal information only for specific, explicitly defined purposes related to providing immigration consultancy services. We retain records only as long as necessary for these purposes or as required by law.
4. Further Processing Limitation
We do not use personal information for purposes other than those originally specified, unless the new purpose is compatible with the original purpose or we obtain additional consent.
5. Information Quality
We take reasonable steps to ensure that personal information is complete, accurate, not misleading, and updated where necessary. We encourage clients to inform us of any changes to their personal information.
6. Openness
We are transparent about our data processing activities. This compliance page, our Privacy Policy, and other communications ensure that data subjects understand how their information is being used.
7. Security Safeguards
We implement appropriate technical and organizational measures to protect personal information against:
- Loss, theft, or damage
- Unauthorized access
- Unlawful processing
- Accidental destruction
Our security measures include password protection, access controls, encrypted communications, and secure document storage systems.
8. Data Subject Participation

Direct Marketing
We respect your privacy preferences. We will not send you direct marketing communications without your consent. You may opt out of marketing communications at any time by contacting us or using the unsubscribe link in our emails.
Cross-Border Data Transfers
As an immigration consultancy, we may need to share information with government authorities (such as the Department of Home Affairs) and third-party service providers (such as translators or document authenticators). Any cross-border transfers are conducted in compliance with POPIA requirements.
Data Breach Notification
In the unlikely event of a data breach that poses a risk to your rights and freedoms, we will notify the Information Regulator and affected data subjects as required by POPIA, without undue delay.
Record Retention
We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, or as required by law. Immigration-related records are typically retained for periods specified by applicable legislation.
